The new crime of transmitting sexually explicit Deepfakes – 5 key points you should know
It is an offence under Commonwealth law to use a carriage service to share sexually explicit material of an adult without their consent, including deepfakes. The offence applies whether the material is real, altered, or entirely AI-generated, and carries a maximum penalty of 6 years’ imprisonment or 7 years if the person also created or modified the content.
